DUI Breath Testing in Boulder County, Colorado

In many cases, you may be required to submit to a breathalyzer test, per state law. Boulder County law enforcement utilizes an Intoxilizer 9000.

Breathalyzer devices are known for malfunctions that impact performance, including required retesting, problems with uploading data, data loss, and abnormal readings. Conditions as simple as using mouth wash and breath mints can result in false positives.

Restoring ROC – Boulder County offers the Restoring Our Community Program (ROC). ROC is a voluntary substance use disorder treatment program designed for men who have three or more drinking/drugging and driving offenses. The program provides relapse prevention, problems solving, and communications tools.

State upholds warrantless blood draws – In 2017, the state upheld Colorado’s expressed consent laws after lower circuit judges threw out blood tests in a previous case. If it didn’t, Arapahoe District Attorney Jennifer Gilbert was quoted as saying that “it could have invalidated every breath or blood test that a driver in Colorado provides as part of a DUI investigation.” This means that express consent laws are extremely strong in Colorado, and that the chances of a blood or breath test being thrown out in Boulder County as a result of not having a warrant is slim.

Colorado considering new refusal laws – Colorado Lawmakers are considering HB 1135, a bill to establish new regulations on commercial drivers. However, the bill comes with “additional latitude,” according to the article. This latitude includes new restrictions on DUI test refusals, which lawmakers say have risen to nearly 50% in 2022. Under the bill, refusing a test would be charged the same as the actual DUI.
