State upholds warrantless blood draws – In 2017, the state upheld Colorado’s expressed consent laws after lower circuit judges threw out blood tests in a previous case. If it didn’t, Arapahoe District Attorney Jennifer Gilbert was quoted as saying that “it could have invalidated every breath or blood test that a driver in Colorado provides as part of a DUI investigation.” This means that express consent laws are extremely strong in Colorado, and that the chances of a blood or breath test being thrown out in Jefferson County as a result of not having a warrant is slim.
