What Does Colorado Classify as Vehicular Assault?

Any driver whose reckless or careless actions resulted in the serious bodily injury of another could face vehicular assault charges. The crime is defined under the Colorado Revised Statutes (CRS) 18-3-205, which state vehicular assault is when a person does the following:

  • Drives in a reckless & careless manner OR is under the influence of alcohol or drugs; and
  • Is the direct cause of a serious bodily injury sustained by another person.

Please note, the term “serious bodily injury” is defined under Colorado law as any injury which, either at the time of the actual injury or later on, involves one of the following factors:

  • Permanent disfigurement
  • Protracted loss or impairment of a function of any part of your body or organs
  • Breaks of the bone or second/third-degree burns
  • A substantial risk of death

Penalties for Vehicular Assault in Colorado

The sentencing for vehicular assault depends on the unique facts of the case. If another person was injured because you were simply reckless or careless, you’ll face a class 5 felony. The maximum sentence you may receive for a class 5 felony includes:

  • Up to 3 years in prison
  • Mandatory parole for up to 2 years
  • A fine of up to $100,000

If your reckless actions were because you were impaired by drugs or alcohol, then you’ll instead face a class 4 felony. The penalties for a class 4 felony include:

  • Up to 6 years in prison
  • Mandatory parole for 3 years
  • A fine of up to $500,000
